Expert Witness

J.A. McClelland & Sons act as expert witnesses mainly in property related disputes concerning valuations for partnership dissolution and dispute resolution procedures. This involves preparing valuation reports and making representations to Court, Arbitrators or Independent Experts.

While going to Court should be the last resort, it may be necessary. Property matters may be heard in different courts or quasi-judicial settings for example County Court, High Court, Lands Tribunal. Such work will be done to the standard set out in the RICS Guidance Notes "Surveyors Acting as Expert Witnesses" "Chartered Surveyors Acting as Advocates".

Dispute resolution is unique within RICS, because dispute avoidance, management and resolution are areas of professional practice in which surveyors of all disciplines are at one time or another, involved. The dispute resolution process requires proficient communication and negotiation skills to achieve a settlement, whether through Alternative Dispute Resolution (ADR) procedures, i.e. arbitration, independent expert determination, adjudication and mediation or litigation.
