Compulsory Purchase and Compensation

Landowners and farmers can expect to be faced with compulsory purchase schemes from time to time, from new roads and footpaths to pipelines and cables; they are an inevitable fact of rural life.

Compensation following a compulsory acquisition of land is based on the principle of equivalence; this means that you should be no worse off in financial terms after the acquisition than you were before. J.A. McClelland & Sons work to negotiate that clients receive full and fair compensation, endure minimal disruption and identify any possible windfall benefits or consequences, of the scheme.

Our services include:
  • Advice on action before schemes begin
  • Opposing compulsory purchase proposals
  • Submitting claims
  • Representing clients at the Lands Tribunal Hearings, including preparing evidence and providing comparable values

There are a considerable number of factors and issues to be considered in making a claim for compensation, home owners may even be eligible for compensation payments when no land is purchased. Blight from noise, fumes, dust, light, vibration are just as valid.

J.A. McClelland & Sons advisory team has a wealth of experience in compulsory purchase and compensation.  We provide comprehensive knowledge of compulsory purchase procedures and of their real impact and implications having represented a vast number of clients affected by the BGE North-West and North-South gas pipeline and more recently the Dunore to Hydepark Truck Main.

The majority of our work is acting on behalf of landowners and occupiers, we liaise with the design engineers, to ensure the scheme fits in as best as possible with your existing business and its future needs. We agree accommodation works to minimise the impact of the scheme and liaise closely with the contractors so that there is minimum disruption as the works proceed.

And finally, the Acquiring Authority will pay most if not all of the fees for expert advice, allowing you to benefit from our knowledge at minimal cost.
